A common misconception persists among taxpayers and practitioners alike: that the 10% tax rebate is available broadly to all female taxpayers. The law is far more precise. Here is what the statute actually requires.

The statutory provision

Notwithstanding anything written elsewhere in this section, if a resident natural person is a woman earning only remuneration income, she shall receive a 10% rebate on the tax payable by her.

The operative Nepali word is मात्र, meaning solely or exclusively. It is not incidental language. It is the legal threshold.

Critical nuance: Final Withholding Income under Section 92

Key legal point

Interest from bank fixed deposits (non-business) and dividends or bonus shares from resident listed companies are classified as Final Withholding Payments (अन्तिम रूपमा कर कट्टी हुने भुक्तानी) under Section 92. The directive is explicit: such income is taxed finally at source and must not be included in the individual's regular assessable or taxable income (आयमा समावेश गर्नु पदैन). Accordingly, a salaried woman who also receives FD interest or dividends is still treated as earning remuneration income only for the purpose of the rebate, because her Final Withholding income is entirely excluded from her taxable income computation.

Section 92 reference: Final Withholding Payments are taxed at the point of payment at prescribed rates. They are not aggregated into the payee's annual taxable income and do not affect the character of her other income for rebate eligibility purposes.

FD Interest and Dividends

Final Withholding Tax: Taxed finally at source via TDS. Not included in annual taxable income. No further tax liability arises on this income.

Employment Income

Salary Tax with 10% Rebate: Calculated under regular salary slabs. A 10% rebate is applied on the final calculated employment tax.

Final Withholding Income does not enter the taxable income computation at all. It is therefore invisible to the "remuneration income only" test. A salaried woman earning FD interest or dividends retains full eligibility for the 10% rebate on her employment tax.
